Option D: Rental Plus Storage
Status: candidate. Explored 2026-10-03. Round 4 checked the rental, storage and insurance questions. Its education extension is Option E. All options: Business Model Options. Not legal advice.
How it works
- The owner rents the mobile unit (or a towable kill trailer) and does the kill and cut themselves.
- The company stores carcasses (hanging) and, optionally, frozen boxes in a storage-only cooler for a fee.
- The company cleans and inspects the unit between renters; it does not touch the animal.
Legal basis
- Personal use: 9 CFR 303.1(a)(1) exempts “slaughtering by any individual of livestock of his own raising, and the preparation by him” for his household (9 CFR 303.1).
- VDACS: a buyer may use a farm’s facilities to slaughter a purchased animal and it stays personal use; “If the seller participates in the slaughter or processing activity, then the facility owner is subject to the custom exempt criteria and must have a Custom Permit.” (VDACS). That sentence addresses the seller who is also the facility owner; applying it to a third-party rental company is an analogy [inferred], so the renter’s status should go to OMPS in writing. VDACS appears to read the buyer case more generously than the federal “own raising” text [inferred]: get its position in writing (Minnesota comparison).
- Comparison states (persuasive only): Vermont defines “assist” as “the act of slaughtering or butchering” and excludes the selling farmer’s provision of a site, implements, or offal disposal; by analogy [inferred], equipment rental alone is not assisting (Vermont); Maine authorizes renting a slaughterhouse, poultry only, and the renter must do the work (Maine). In every text found, the test is who performs the work; payment is not an element [inferred].
- Storage: a fee-based locker for others is likely the “public warehouse” class: free 3-year VDACS Handlers Permit, records, OMPS visits; permit holders “may not open packages … or further process” (Handlers Permit; § 3.2-5404). Federal 9 CFR 320.5 registration applies only “in or for commerce” (interstate) (9 CFR 320). Status for owner-held uninspected carcasses: unverified, ask OMPS.
Zoning and site (Frederick County)
- Farm side: the RA slaughterhouse definition “shall not be construed to prohibit persons who are actually farmers from killing their own cattle … for their own family use” (RA). A renter killing their own animal fits this exception cleanly; a renter who bought the animal is less clear [inferred].
- Yard and cooler: B3 combines “Warehousing and Storage”, “Car, Truck, Utility Trailers, and RV … Rental and Leasing”, truck repair and parking, all by right. A 53 ft semi is not a utility trailer, so the rental classification is uncertain; unit washing may be “Machinery Cleaning” (M1 only) (Article VI).
Waste
- Offal on the farm of generation fits 9VAC20-81-95 D.4 cleanly, because the renter is the farm (DEQ).
- Blood and wash water: the renter’s problem on paper, but the rental agreement should require blood capture and a holding tank (the NC agreement makes the renter “solely responsible” for offal disposal) (Orange/Durham agreement).
- Sanitation between renters falls on the company.
Capacity and labor
- No cutter-labor ceiling: the renter does the work. The limit is rental days and units.
- Company labor: scheduling, delivery (if owner-towed), cleaning, inspection, storage handling.
- A 53 ft semi is not renter-towable (Class A CDL). Towable custom-exempt trailers ($72k-$115k) have no cutting room, so renters would still cut elsewhere [inferred].
- Precedent: no red-meat unit in NMPAN’s directory is rented DIY; every red-meat MSU is owner-operated or run by a contracted processor. All rental programs found are poultry (NMPAN directory).
Economics
Rough need [placeholder]: about $100-120k/yr to cover about $56k debt service plus about $40-60k operations. Example: $400/rental day + about $50/head storage, about 200 rental days/yr.
| Benchmark | Value | Year | Source |
|---|---|---|---|
| Poultry MPU rental, NC Extension | $25/day (3-day min) to $75 per 4-5 days; $50-100 cleaning fee | 2026 | NC fee sheets |
| Poultry MPU, Pine Stump Farms WA | $150/day + $200 deposit; $100/yr membership | c. 2012-15 | NMPAN directory |
| Poultry MPU, Kentucky State Univ. | $75 first 50 birds + $0.75 each; training $75 | 2013 | KSU |
| Carcass dry-aging | $25/head/week past 2 weeks (T&E) | 2025 | Valley prices |
| Storage after 72 h | $10/day per cart (Blue Ridge Meats) | 2026 | Blue Ridge |
| Community freezer locker bin | $5-8/month (Cornell CE, NY) | 2015 | NPR |
No red-meat rental rate was found. Poultry rates are subsidized and nominal; they show structure (training-gated, deposit, cleaning fee), not price.
What it fixes
- Removes the cutting-labor ceiling.
- Fits the RA farmer-family-use exception and D.4 offal rule cleanly.
- Cooler is storage only (B3 by right).
What it costs
- Market mismatch: freezer-beef producers selling halves and quarters to other households cannot use personal-use; they would need their own (free) Custom Permit and its obligations.
- Participation trap [inferred]: the VDACS text covers a seller/facility owner who participates; by analogy, if staff help, the company is likely “participating” and a custom operator again. A third-party renter’s status is for OMPS to settle (Option E questions 1-3).
- Liability: amateurs with a stunning firearm, winches, saws and grinders. Virginia voids pre-injury personal-injury waivers (Hiett v. Lake Barcroft, 244 Va. 191, 1992) (Hiett). The agritourism inherent-risk statute (Va. Code § 3.2-6400 to 6402) never covers negligence and probably does not reach an off-site trailer rental (agritourism).
- Insurance pattern: rental programs insure only the unit and its transport; renters carry their own farm and product liability. Kentucky’s $1M per-user requirement was “prohibitively expensive” and was dropped only after a university took ownership (NMPAN insurance; KSU).
- Demand for DIY beef processing is unverified.
Open questions
- VDACS: does a renter who bought (not raised) the animal stay personal use? What counts as the company “participating”?
- OMPS: does a cooler holding owner-held uninspected carcasses need a Handlers Permit?
- Zoning Administrator: is renting a 53 ft processing semi “trailer rental” in B3?
- Broker quote: rental-equipment GL plus inland marine on the unit.
- Demand: how many Valley owners would kill and cut their own beef?
Verdict
Candidate, high uncertainty. Best as a variant, not a standalone business: (1) an off-season rental add-on (Feb-Apr), including hogs, sheep and goats; or (2) two tiers, “you do it” rental plus storage and “we do it” full service under the operator’s free Custom Permit. Demand and safety are the gaps that Option E tries to close.
