Cooler Site Permits

Bottom line [inferred]. A cooler that only stores carcasses might pass as a farm use. A cooler where a mobile unit docks to cut is a meat-processing site: a CUP in RA, or by right only in M2 (Industrial General), plus a wastewater solution. Correction (2026-10-03): earlier text said a commercial parcel “may be simpler”; Frederick County’s B2 commercial district does not allow it at all. Get a written use determination from the Frederick County Zoning Administrator (§ 165-101.06) before buying land or equipment.

Zoning: Frederick County Ch. 165, RA district

Read from Wayback snapshots dated 2026-07-11; the code’s last amendment was 2026-05-13 (zoning).

Question Answer
Is a slaughterhouse allowed by right? No. Conditional use BB “Slaughterhouses” (§ 165-401.03)
What counts as a slaughterhouse? “Establishments primarily engaged in the slaughtering or processing of meats for human consumption.” § 165-204.17A reaches any establishment where animals “dead or alive, are processed”
Can it be agricultural storage by right? Only storage “in its unmanufactured state” and only if the farm “regularly produces more than 1/2 of the commodity so treated”. A service cooler for other owners fails this
Cold storage or warehouse? Not a listed RA use. “Warehousing and Storage” is by right only in B3 (see below)
CUP conditions (§ 165-204.17) Buildings, unloading and pens ≥ 100 ft from property lines; total buildings ≤ 20,000 sq ft; all operations under roof, screened from neighbours and roads; 14-gauge screens; extra buffering at the administrator’s discretion
Process Planning Commission and Board of Supervisors public hearings, plus a site plan
Wastewater hint RA restaurants (CUP E) must have an approved drainfield, and “pump and hauls are prohibited”

Siting options [inferred]: 1. RA parcel with a CUP. Budget for the hearings, the setbacks, and a roofed dock bay so the trailer’s cutting is “under roof”. 2. M2 (Industrial General) parcel, likely with public sewer. By right for a cooler plus cutting dock, and sewer solves dock wastewater. It loses the farm-building exemption (full commercial building permit) and costs more in land or lease. B2 commercial land does not work (see below). 3. B3 parcel for a storage-only cooler (no cutting on site), as in Option C or D of the Business Model Options. 4. Cooler on the operator’s own farm, storing mostly the farm’s own beef. This fits by-right agriculture but defeats the service model.

Zoning: business and industrial districts (round 4)

Article VI use lists, read from Wayback 2026 snapshots (allowed-use tables amended 7-10-2024). Uses are classified by NAICS and the Zoning Administrator decides (Article VI).

District Cooler + cutting dock (“Animal Slaughtering and Processing”) Storage-only cooler (“Warehousing and Storage”)
B2 General Business Not listed Not listed
B3 Industrial Transition Not listed By right
TM Technology-Manufacturing Expressly excluded from food manufacturing Secondary use only (up to 50% of floor area), 10-acre minimum
M1 Light Industrial Expressly excluded from food manufacturing Not listed by name: needs a Zoning Administrator classification; unconfirmed
M2 Industrial General By right: “Food Manufacturing including Animal Slaughtering and Processing” Inherits M1’s list (same gap) unless accessory to the processing use

Not checked: how Shenandoah and Clarke counties zone this. Siting outside Frederick County may be easier.

Building code

Sanitation: 9 CFR 416.1–416.6 for the cooler

These are performance standards, not a construction spec (416): - Walls, floor and ceiling made of durable materials impervious to moisture. Openings that keep vermin out. Ventilation that controls condensation. - No inedible material in the carcass cooler (416.2(b)(4)). Carcasses protected while loading and unloading (416.4(d)). - Private well: potability documented, “renewed at least semi-annually” (416.2(g)(1)). Private sewage: a health-authority approval letter on request (416.2(f)). - Written sanitation SOPs (416.11–17) are federally required only of inspected plants. - In Virginia, 2VAC5-210 adopts these via the federal rule text as of Jan 1, 2021. Still unknown: whether OMPS inspects the cooler as part of the Custom Permit.

Water supply

A small cooler with a mobile crew is far below VDH waterworks thresholds (12VAC5-590): ≥15 connections or ≥25 people for ≥60 days a year; a nontransient system needs 25 of the same people for 6+ months. A private well is fine, with the semi-annual coliform test above. The one risk is customer pickup bringing 25+ people a day (12VAC5-590).

Wastewater at the dock

Route Rule Fit
Public sewer (Frederick Water) Excluded from DEQ permits (9VAC25-32-40(1)). Grease trap may be required by county building inspections; pretreatment plans need DEQ approval. No stormwater to sewer, so the wash-down pad must be roofed or bermed. 2025 rates: $50.18/month base (¾-in. meter) + $7.03–11.06 per 1,000 gal. 2019-era fees: $3,076 availability + $3,500 lateral Best (Frederick Water)
VDH-permitted onsite system (AOSS) Must be custom-engineered and PE-sealed “for the anticipated receiving wastewater characteristics”. The design-flow table has no meat category; over 1,000 gpd is a Large AOSS. A staffed building also needs a separate domestic system Possible, but costly (VDH)
Pump-and-haul VDH permit route (12VAC5-610-410 to 440) Frederick County bans it for RA restaurants, so expect resistance
Land application Needs a DEQ VPA permit. Blood and wash water are “industrial wastes”; no general permit for small meat processors Hard (VPA)

Volume and strength are covered in Slaughter Waste Disposal in Virginia.

Calls

  1. Frederick County Zoning Administrator: use determination for a cooler where a mobile cut unit docks (RA CUP vs M2); whether § 165-204.17 applies in M2; whether a storage-only carcass cooler is “Warehousing and Storage” (B3). Also get a CUP timeline and cost.
  2. Frederick Water / FWSA: sewer availability at candidate parcels, discharge limits, and any high-strength surcharge.
  3. Frederick County building official: would a cooler on a working farm get the § 36-97 exemption?
  4. VDACS OMPS: does the Custom Permit cover the docked cut room and the cooler, and is there a site inspection?
  5. Shenandoah and Clarke county zoning offices: comparison.
